These Terms of Use govern your access to and use of The Silence Is Broken platform (“Platform”), including our website, any mobile applications, and all content and services offered therein. By accessing the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

When we say “we,” “us,” or “SIB,” we mean The Silence Is Broken, the creator and operator of this Platform. When we say “you,” we mean you, the person using the Platform.

1. Eligibility

You must be at least 18 years old to use this Platform. If you are between 13 and 18, you may use the Platform only with a parent or legal guardian’s permission. Children under 13 may not use the Platform.

2. Registration & Account

To access content on the Platform, you must register with your name and email address. You agree that all information you provide is accurate and complete, and you will keep it up to date. You are responsible for maintaining the security of your account.

3. License to Use

We grant you a limited, personal, non-commercial license to access and view content on the Platform. This license does not permit you to:

  • Copy, modify, or create derivative works from any Platform content
  • Publicly display or commercially exploit any content
  • Reverse engineer any Platform software
  • Transfer or ‘mirror’ any Platform material to another server
  • Remove any copyright or proprietary notices

Downloads are only permitted where content is explicitly labeled DOWNLOADABLE. This license terminates automatically if you violate these Terms.

4. Payments & Refunds

Some content requires payment of a fee. Payments are processed through third-party payment processors — we do not store your sensitive payment information.

Refund policy: Due to affiliate sales and musical and visual intellectual property, no refunds are granted after seven (7) days of purchase. After that period, your access continues until the end of your membership year.

5. Community Standards

Our Platform includes public discussion forums. Participation is voluntary. If you choose to participate, you agree not to post content that:

  • Is hateful, defamatory, threatening, or harassing
  • Promotes violence, illegal activity, or endangers any individual
  • Constitutes spam, scams, or attempts to drive traffic to third-party sites
  • Violates another person’s privacy or impersonates any person or organization
  • Introduces malware or attempts to disrupt or gain unauthorized access to the Platform

We reserve the right to remove content or suspend access at any time if these standards are violated.

6. Your Content & Feedback

Any content you post on the Platform remains your responsibility. By posting, you grant SIB a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and distribute that content in any media.

Similarly, any feedback or suggestions you submit about the Platform may be used by us freely without obligation to you.

7. Intellectual Property

All content, design, trademarks, logos, audio, video, and materials on the Platform are owned by or licensed to SIB (“SIB Intellectual Property”). You do not acquire any ownership rights by using the Platform. Unauthorized reproduction, modification, or distribution of SIB Intellectual Property is strictly prohibited.

8. Third-Party Links

The Platform may contain links to third-party websites. SIB does not endorse or control those sites and is not responsible for their content. Use of any linked site is at your own risk.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be error-free, uninterrupted, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, SIB shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold SIB and its officers, directors, agents, and employees harmless from any claims, damages, or expenses — including reasonable legal fees — arising from your breach of these Terms or violation of any applicable law or third-party rights.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in California.

13. Changes to These Terms

We may update these Terms at any time. When we do, we will post the revised Terms with an updated date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
